These Terms and Conditions ("Terms") govern your use of the Golf Ball IQ website at mygolfballiq.com, mobile application, and related services (together, the "Service"), operated by Golf Ball IQ ("Golf Ball IQ," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Golf Ball IQ is an informational golf ball fitting tool. You answer questions about your game, and we generate personalized golf ball recommendations, ranked with match scores and explanations, and provide links to third-party retailers where products may be purchased.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service or make a purchase. By using the Service, you represent that you meet this requirement.

3. Important disclaimers — please read

• Recommendations are informational only. Our recommendations are suggestions generated by a software model based on the information you provide and on general product data. They are not professional club-fitting, coaching, medical, or financial advice, and they are not guarantees of any particular result.
• No performance guarantee. We do not guarantee that any recommended ball will improve your scores, distance, accuracy, or performance. Golf performance depends on many factors we do not measure, including swing mechanics, loft, angle of attack, strike quality, and course and weather conditions.
• Ball data is estimated. Golf ball specifications shown in the Service (such as compression, spin, feel, and price) are aggregated from publicly available sources and shown as estimates. They are not verified laboratory data and may be inaccurate, incomplete, or out of date. Prices change frequently and may differ from those shown.
• Not affiliated with manufacturers. Golf Ball IQ is an independent service and is not affiliated with, endorsed by, or sponsored by any golf ball or equipment manufacturer. All product names, brands, and trademarks are the property of their respective owners and are used for identification and descriptive purposes only.

4. Third-party retailers and affiliate links

The Service contains links to third-party retailers. We are not the seller of any product and are not a party to any transaction between you and a retailer. Purchases, pricing, availability, payment, shipping, returns, and warranties are governed solely by the retailer's own terms. We are not responsible for third-party websites, products, or services.

We participate in affiliate programs and may earn a commission when you purchase through links on the Service, at no additional cost to you. This does not influence which products our model recommends.

5. Subscriptions and payments

Certain features may require a paid subscription (for example, monthly, annual, or lifetime plans; current pricing is shown in the app before you purchase).

• Billing. Subscriptions purchased through the Apple App Store or Google Play are billed through your app-store account and are subject to that store's terms. Auto-renewing subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Cancellation and refunds. You can manage or cancel a subscription through your app-store account settings. Refunds, where available, are handled according to the applicable app store's policies. Except where required by law, payments are non-refundable.
• Price changes. We may change subscription prices; changes apply to future billing periods and, where required, we will provide notice.

6. Accounts

If the Service offers accounts, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

7. Acceptable use

You agree not to: - Use the Service for any unlawful purpose or in violation of these Terms; - Copy, scrape, reverse engineer, or attempt to extract our data, scoring model, or source code, except as permitted by law; - Interfere with or disrupt the Service or its infrastructure; - Use the Service to build or train a competing product or dataset; - Misrepresent your identity or affiliation.

8. Intellectual property

The Service, including its design, text, graphics, logos, the "Golf Ball IQ" name and marks, and the fitting model and its scoring logic, is owned by Golf Ball IQ and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECOMMENDATION OR DATA IS ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLF BALL IQ AND ITS OWNERS AND OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.

11. Indemnification

You agree to indemnify and hold harmless Golf Ball IQ and its owners and operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules.

Informal resolution first. Before bringing any claim, you agree to try to resolve it informally by contacting us at support@mygolfballiq.com and giving us 30 days to respond.

Venue. To the extent any dispute proceeds in court, it will be brought exclusively in the state or federal courts located in Albany County, New York, and you consent to the personal jurisdiction of those courts.
